Senator Max Baucus of Montana is introducing a new bill to make the 2009 estate tax law permanent and reunify the estate and gift taxes.
The new law would keep the estate tax exemption at $3.5 million for individuals and $7 million for couples. Survivors would be taxed family survivors up to 45 percent on assets that exceed the exemption. Additionally, the new law would allow portability of the exemption for spouses, according to Baucus, D-Mont., chairman of the Senate Finance Committee.
Otherwise, in 2010 the estate tax would have been eliminated. In light of the huge federal deficit it should come as no suprirse that the government is looking for ways to at least maintain the current tax base.
The bill is expected to be passed into law in August of 2009.
